The UK Border Agency has launched the ''Highly Trusted Sponsor Scheme'' for education providers under Tier 4 of the points-based system.
Tier 4 sponsors can apply for a Highly Trusted Sponsor licence from today, and the register of highly trusted sponsors will go live on Tuesday 6 April 2010.
Under the UK''s points-based system for controlling migration, all sponsors are rated according to their track record and procedures for monitoring overseas students. We are now expanding and building on this rating process.
The new scheme is about immigration control, not academic achievement. To qualify as a highly trusted sponsor, an education provider must have a proven track record in recruiting genuine international students who comply with immigration rules while they are in the UK.
The scheme will cut red tape for sponsors who qualify. It will also allow us to monitor other sponsors more thoroughly, focusing our enforcement activity on those who seek to abuse the system. We will be applying minimum standards for all sponsors; where appropriate, we will suspend or revoke the licences of sponsors who fail to meet these standards.
Compared with other Tier 4 (General) sponsors, a highly trusted sponsor will be able to offer a wider range of courses to overseas students. It will also be offered new services and benefits, such as a dedicated account management function and a more flexible approach to reporting student non-attendance.

Major changes announced for Tier 1 and Tier 2 of the points-based system

The Government has unveiled widespread changes to Tier 1 and Tier 2 of the points-based system. The changes are due to take effect from 6 April 2010 and come on the heels of recommendations put forward by the Migration Advisory Committee (MAC) following their reviews of the Tier 1 and Tier 2 visa categories which took place during the second half of 2009.
The Government has now chosen to accept the majority of the MAC’s recommendations for Tier 1, and has set out further details of how it will implement changes the MAC recommended to Tier 2.
Key changes that will take effect from 6 April 2010 include:

The introduction of revised points tables for the Tier 1 and Tier 2 categories.
A simpler route for very highly skilled workers without Master''s degrees, whereby applicants with very high previous earnings (£150,000 or above) can come to the UK under Tier 1 (General), even if they have no formal qualifications at a high level.
The re-introduction of points for a Bachelor level qualification for Tier 1, meaning that anyone with a Bachelor’s degree can now make an application under Tier 1, providing they also satisfy the remaining criteria.
A reduction to the initial length of stay granted under Tier 1, whereby new applicants under Tier 1 will now be granted a Tier 1 (General) visa for 2 years, as opposed to the current 3 year validity. After the initial 2 year period, Tier 1 (General) visa holders will be able to apply for an extension of 3 years, bringing their period of leave up to a total of 5 years.
Changes to the salary bands for the Tier 2 points table to align it more closely to the salary bandings for resident skilled workers.
The introduction of three new sub-categories within the existing Tier 2 (Intra-Company Transfer) category.

Overall this latest round of changes is designed to provide added flexibility to employers without compromising the aims of the system and the protection offered to resident workers. In addition to the changes recommended by the MAC the Government will also be making other changes to Tiers 1 and 2, including altering the provisions for doctors in training, and a new route for skills transfers. These changes are a result of feedback received by the Government from sponsors, employers and users of the points-based system.
Transitional arrangements
Transitional arrangements will be put in place so as not to impact negatively on migrants already in the UK under any of the above categories. The changes will come into effect on 6 April 2010 and any applications that are made before the new rules come into effect will be considered under the rules in place on the date of the application.

The Migration Advisory Committee’s (MAC) latest report has recommended that the Government retain the role of Skilled Chef on its shortage occupation list, a move that if accepted will enable restaurants to continue to recruit foreign Skilled Chefs for positions under the Tier 2 Work Permit system without having to carry out a resident labour market test first.
Prior to the release of the report there was widespread speculation that the MAC’s recommendation would to remove the role of skilled chefs from the list of shortage occupations. However, significant lobbying by key stakeholders in the restaurant/catering sector including the Department for Culture, Media and Sport, Visalogic, and the British Hospitality Association resulted in the presentation of compelling evidence to suggest that there is a very real shortage of suitably qualified, trained and experienced chefs from which to fill labour shortages.
“As the immigration representative for a number of the UK’s most prominent restaurants and caterers we recognise the difficulties they experience in finding chefs with the skills, techniques and cultural appreciation required to produce ethnic food of the highest quality.” states Shazmeen Ali, Senior Immigration Consultant at Visalogic.
“While we appreciate that in some instances the role of chef is not deemed to be skilled as it does not meet the MAC’s skill criteria, we propose that for its next review the MAC should consider placing stricter qualifying criteria on the role that would reflect the requirement that skilled chef applicants under Tier 2 can display a minimum level of demonstrable experience – something which the current criterion does not reflect.”
As part of its findings MAC have recommended that in order for a foreign skilled chef to be considered under the shortage occupation title of Skilled Chef the role must provide for a salary of at least £8.45 per hour after deductions for accommodation and meals, plus the worker required to fill the role must have at least three years’ relevant experience.
The next MAC review is due to take place in autumn 2010, at which time the sector and its stakeholders will again be asked to demonstrate thoroughly that it is sensible for skilled chefs to remain on the shortage occupation list. The sector will be required to present strong evidence that a concerted and sustained effort is being made to train UK labour to fill some of the shortage gaps – its ability to do so will go a long way to ensuring that skilled chefs maintain their place on the shortage occupation list.
